so, some of you P.Neters are at risk of winding up on this site. It's high time to get new promo photos.

Looking through though, he posted a few that he likes... he doesn't really know what he's talking about.... and some of these people he ripped on don't deserve it.... some do and need it.

Nice subtle shameless self promotion there, Evan, very slick, young padawan.

Thanks Eric.

Honestly, I'm not worried about self promoting my photography, I'm worried about your promotion (all you guys). I'm freaking busy with my own tours, promotion of my tours, refining material; and don't have time to give a rats ass about guys unless you care... if you want me to help you I will, and I will give you the best service I possibly can.
Or ya'll can get the $15 wal mart photos and wind up on this site getting ridiculed by your peers, and not booking the gigs you deserve.

Default I know two of those guys!

The flying coin dude, and the old guy with the rainbow streamer.

I found myself paging through all of it just to see if there were other KC guys.

I have to find a pic of myself to have mocked, now.

Saw my buddy JoeJoe in there

The blue hair guy with the ACDC shirt floating the cigarette on the 1st page I think

I think that pic is pretty cool, not just because I know him either..

The guy criticized him not for the picture but for having blue hair and wearing an ACDC shirt

Default Copyright Violation...

As one of the acts skewered - I have a different "insight" on this blog.

I was notified a graphic from one of my old shows was on there. Had the guy given his opinions on the graphic, it would be one thing. Instead he made a comment about "f'ing" the pig. I checked further - and found a second pic of my vent act, and again no critique, but comments about being up the duck.

You want to critique my show, fine, you are entitled to your opinion. You want to critique (and I use that term VERY loosely in this case) or use my materials, ask permission, they are copyrighted.

Why is it as performers, everyone spouts not stealing - yet no one stepped up to the plate and called this "blogger" for using photos without consent of the copyright owners?

I don't play games. I've reported the images as a copyright violation to eBlogger.

Tom,
Copyright is limited by 'Fair Use'.
I believe the content of the website would be considered a 'Parody'.

Perhaps, but I don't see this as parody. I've dealt with image theft before. Call it ridiculous if you want, but I've reported the issue. Now I'll wait and see what Google thinks...

My pics are no longer on the site. Guess Google didn't see it as a parody either.

Parody is an original work of art BASED on someone else's work - it's not just making fun of an original work.

So South Park can parody Les Miserables by writing a piece that sounds like a Les Miz song and singing it in a Les Miz style, but they can't play the original song and have their characters talk about how terrible it is (or even how great it is), unless they license the song and pay royalties.

Incidentally, in Canada, one does not have the right to parody; in the USA it's a little murky but generally legal. This gets particularly funky in parody music, because the songwriter, the lyrics writer, and the arranger all have a vested interest.

Tom,

You're right, and I think it is unfortunate that you've had your website images ridiculed like that. I saw that link a few days ago from a different reference than p.net and was less than impressed with this particular magician's tact and professionalism. Yeah, I was still amused by the pictures, but we've all got weak points that are easy targets for ridicule. Cheap shots all around. If it bothers you enough, you may just need to get new photos done and move on ignoring those who need to put others down in order to feel better about themselves.

No, it is not a parody, it is just petty trash talk.

Unfortunately, this is one of those situations that I keep this around for:

Steven,

Liked the form!

What bothered me more was the use of my material without permission. I can take a cheap shot here and there. I've been getting them since I spoke up.

Just because Google took it down does not mean that they did not see it as parody.

Isabella:
Here's the definition of parody from Stanford University:
"A parody is a work that ridicules another, usually well-known work, by imitating it in a comic way. Judges understand that by its nature, parody demands some taking from the original work being parodied. Unlike other forms of fair use, a fairly extensive use of the original work is permitted in a parody in order to "conjure up" the original."
Here's the link:

Google removes almost anything they get a complaint on... especially if they sound like a litigious motherfucker.

I also think that it wouldn't be considered a copywrite issue, unless you are using it to make money. I'm more than willing to accept being wrong on that point, though.
